Supreme Court Provides Options on filing Appeals


On June 2, 2010, the Supreme Court signed an order adopting rules that will provide an option for litigants filing appeals. HB 1055 raised the fee charged by the Superior Court Clerks to prepare a record for appeal from $1.50 to $10.00 per page. This fee had not been increased since 1971, HB 1055 included the amount adjusted for inflation.
 
There is concern among the legal community that the fee was too much and would limit access to the courts. Based on that concern, the Supreme Court adopted rules providing some options that would allow the attorneys to prepare the record and file directly with the Supreme Court, bypassing the local trial court, thereby allowing the parties to avoid paying the fees for the record preparation at the county level. While this may reduce revenue at the county level, it will also reduce the workload in the Superior Court Clerk's offices.
