Local Governments Must Adopt Outdoor Watering Ordinances

Local Governments Must Adopt Outdoor Watering Ordinances by January 1

During the 2010 legislative session the Governor’s comprehensive Water Stewardship Act (SB 370) was passed and signed into law.  Among its provisions, Georgia’s counties and cities are required to adopt outdoor watering ordinances which prohibit various outdoor watering uses between the hours of 10:00 a.m. and 4:00 p.m.   These local ordinances must be in effect on January 1, 2011 (O.C.G.A.  § 12-5-7 (a.1)(3)).

ACCG has developed a model ordinance for your county’s consideration.  As with any ordinance, we urge you to consult with your county attorney before adoption.  Please note that this is separate from any drought or non-drought outdoor watering rules which may be promulgated by the state.

Additionally, the Cobb County Water System has provided a useful list of commonly asked questions and answers on the new law for you to distribute as you see fit.
