A Model Ordinance for Decals on County Vehicles


Effective January 1, 2001, all county vehicles are required to have a county decal affixed to the front door, except law enforcement vehicles and other vehicles identified by the board of commissioners in a resolution. ACCG has prepared a model resolution that county commissioners may adopt after holding a public hearing to exempt other county vehicles from the decal requirement. RESOLUTION

 

WHEREAS, the                                   County Board of Commissioners believes that motor vehicles owned or leased by                                  County should be clearly identified with markings, decals and/or seals so that those county services that often go unnoticed are more visible;

 

WHEREAS, making county vehicles easily recognizable allows citizens to see that their tax dollars are appropriately used to provide public services;

 

WHEREAS, in certain situations, however, a clearly marked county vehicle may compromise undercover activities such as law enforcement and code enforcement, as well as skew findings of traffic studies; in other situations, a vehicle may be part of the compensation package for certain county employees;

 

WHEREAS, requiring taxpayers to pay for the application of special decals on all county owned or leased vehicles may be too costly; if the decal damages the paint of a leased vehicle, the county may be subject to a monetary penalty upon the termination of the lease; the placement of decals may lower the fair market value of vehicles that the county will ultimately resell; and

 

WHEREAS, a public hearing was held on                                 [at least 14 days prior to the adoption of the Resolution] to consider which vehicles should not be marked with a seal.

 

NOW, THEREFORE BE IT RESOLVED by the                                         County Board of Commissioners that, in accordance with O.C.G.A. § 36-80-20, the following motor vehicles owned or leased by                                     County shall not be marked with a decal or seal:

 

  1. Any vehicle used for law enforcement purposes;
  2. Any vehicle used for prosecution purposes;
  3.                                                                        
  4.                                                                        
  5.                                                                        
  6.                                                                          
  7.
